Mentorship Terms and Conditions

Introduction

These Mentorship Terms and Conditions ("Mentorship Terms") apply specifically to the Foundation Trading Mentorship and Advanced Trading Mentorship programs offered by Journal-Trades.

These Mentorship Terms supplement the General Terms and Conditions of Journal-Trades. In the event of a conflict, these Mentorship Terms shall prevail with respect to mentorship-related matters.

Article 1 – Definitions

  • 1.1 Journal-Trades: The trade name of Journal-Trades, established in The Hague, the Netherlands.
  • 1.2 Participant: Any natural person who enrolls in, purchases, attends, or participates in a mentorship program offered by Journal-Trades.
  • 1.3 Mentorship Programs: The educational programs offered by Journal-Trades, including but not limited to:
    • Foundation Trading Mentorship
    • Advanced Trading Mentorship
  • 1.4 Mentorship Sessions: Any live or recorded calls, meetings, webinars, workshops, or coaching sessions conducted as part of a Mentorship Program.
  • 1.5 Materials: All educational content provided by Journal-Trades, including videos, recordings, slides, PowerPoint presentations, documents, exercises, charts, examples, frameworks, and written or visual explanations.
  • 1.6 Agreement: The agreement between Journal-Trades and the Participant formed upon enrollment in a Mentorship Program, governed by these Mentorship Terms and the General Terms and Conditions.

Article 2 – Applicability

  • 2.1 These Mentorship Terms apply to all Mentorship Programs, Mentorship Sessions, Materials, and Agreements between Journal-Trades and the Participant.
  • 2.2 By enrolling in or participating in a Mentorship Program, the Participant confirms acceptance of these Mentorship Terms.
  • 2.3 Journal-Trades reserves the right to amend these Mentorship Terms. Continued participation after notification constitutes acceptance of the amended terms.

Article 3 – Eligibility

  • 3.1 Participation in the Mentorship Programs is limited to individuals aged 18 years or older.
  • 3.2 By enrolling, the Participant declares that they meet this eligibility requirement.

Article 4 – Mentorship Programs

4.1 Program Scope

Journal-Trades offers educational mentorship programs, including but not limited to:

  • Foundation Trading Mentorship
  • Advanced Trading Mentorship

Journal-Trades reserves the right to introduce additional mentorship programs, courses, training formats, or educational offerings at any time, which shall also fall under these Mentorship Terms unless explicitly stated otherwise.

4.2 Educational Purpose

All Mentorship Programs are designed exclusively for educational and skill-development purposes.

4.3 Program Content

Mentorship Programs may include, but are not limited to, educational videos, live or recorded sessions, learning modules, practical exercises, examples, explanations, and assessments.

Article 5 – Enrollment and Payment

  • 5.1 Enrollment: Participants must complete the enrollment process and provide accurate contact and registration information.
  • 5.2 Payment Terms: Full payment is required before access to mentorship materials is granted.
  • 5.3 Pricing: Current pricing is displayed on the website. Journal-Trades reserves the right to adjust pricing with advance notice.
  • 5.4 Non-Refundable: All payments are non-refundable once access to digital materials is granted, except where mandatory law requires otherwise.

Article 6 – Program Duration and Access

  • 6.1 Duration: Each Mentorship Program has a specified duration as stated during enrollment.
  • 6.2 Access Period: Participants receive access to materials for the duration of the program and any stated extended access period.
  • 6.3 Content Updates: Journal-Trades may update, modify, or improve program content during the mentorship period.
  • 6.4 Access Revocation: Journal-Trades reserves the right to revoke access in the event of violations or misuse.

Article 7 – Recordings and Consent

  • 7.1 Recordings by Journal-Trades: Mentorship Sessions may be recorded exclusively by Journal-Trades for educational, quality, or participant-access purposes.
  • 7.2 Consent: By participating in a Mentorship Session after prior notice, the Participant consents to being recorded.
  • 7.3 Participant Recordings Prohibited: Participants are strictly prohibited from recording, reproducing, or distributing Mentorship Sessions themselves.
  • 7.4 Opt-Out: If a Participant does not consent to recording, they must notify Journal-Trades in advance. Participation may then be limited or excluded from recorded sessions.

Article 8 – Intellectual Property

8.1 Ownership

All Materials, recordings, presentations, documents, program structures, and content are the exclusive intellectual property of Journal-Trades.

8.2 Prohibited Actions

Participants may not:

  • copy, record, or reproduce materials;
  • share access credentials with third parties;
  • distribute or resell content;
  • use materials for commercial purposes;
  • remove copyright notices or branding.

8.3 Violation Penalty

Violation results in immediate termination and a contractual penalty of €7,500, without prejudice to Journal-Trades' right to claim full damages.

Article 9 – Independent Use of Knowledge

  • 9.1 Journal-Trades does not claim ownership over general trading concepts, strategies, or ideas as such.
  • 9.2 Participants remain free to apply or teach general knowledge gained, provided they do not:
    • use Journal-Trades' Materials;
    • use trade names or branding;
    • suggest affiliation, endorsement, or partnership with Journal-Trades.

Article 10 – No Guaranteed Results

  • 10.1 The Mentorship Programs do not guarantee profits, success, or specific results.
  • 10.2 Journal-Trades does not provide financial, investment, or trading advice.
  • 10.3 Trading involves substantial risk, and Participants act entirely at their own responsibility.

Article 11 – Participant Obligations

  • 11.1 Participants are expected to actively engage with the program.
  • 11.2 Professional and respectful conduct is required at all times.
  • 11.3 Participants are responsible for maintaining account security.

Article 12 – Program Modifications

  • 12.1 Journal-Trades may update or modify program content, structure, or delivery methods.
  • 12.2 Live session schedules may be adjusted with reasonable notice.
  • 12.3 Programs may be discontinued due to unforeseen circumstances without liability.

Article 13 – Liability

  • 13.1 Journal-Trades' liability is limited to the amount paid for the Mentorship Program.
  • 13.2 Journal-Trades is not liable for trading losses, indirect damages, or consequential losses.
  • 13.3 Temporary unavailability due to technical issues, illness, or force majeure does not give rise to liability.

Article 14 – Force Majeure

Journal-Trades is not liable for failure to perform due to events beyond reasonable control, including illness, technical failures, or third-party outages.

Article 15 – Privacy and Data

  • 15.1 Personal data is processed in accordance with GDPR and the Privacy Policy.
  • 15.2 Progress tracking may be used for educational and quality improvement purposes.

Article 16 – Termination

16.1 Journal-Trades may terminate participation if:

  • these Mentorship Terms or General Terms are violated;
  • Materials are shared;
  • payment obligations are not met;
  • disruptive or unprofessional conduct occurs.

16.2 Termination does not entitle the Participant to refunds.

Article 17 – Governing Law and Jurisdiction

  • 17.1 These Mentorship Terms are governed exclusively by Dutch law.
  • 17.2 All disputes shall be submitted to the competent court in The Hague, the Netherlands.
